Definitions

"Conditions" means these terms and conditions:
"Personal Information" means any personal details provided by you via the Website;
"User(s)" means (a) user(s) of the Website either collectively or individually, as the context requires;
"We/us/our" means simplysuns.co.uk a trading name of Chapman Opticians Ltd, registered with the General Optical Council (GOC No: CO-1984)
"Website" means the website located at
www.simplysuns.co.uk or any subsequent URL which may replace it
"You/your" means you as a user of the Website



Liability
Simplysuns.co.uk does not accept any liability for any consequential or incidental or punitive damages whatsoever arising from the use of this website or the purchase of goods or services from this website. All our prescription goods are sold on the basis that they will not be resold, lent, hired, or otherwise supplied to another individual. We reserve the right to refuse to sell any product.
You agree to indemnify simplysuns.co.uk, and its directors and employees harmless from any claim or demand made by a third party, including any legal fees arising for a claim or demand, due or arising out of your submissions to or from the website, your use of the website, your connection to the website, or your violation of the terms and conditions of the website.



Law
The Conditions will be exclusively governed by and construed in accordance with the laws of England and Wales whose Courts will have exclusive jurisdiction in any dispute.



Our responsibilities

We will meet our responsibilities under this contract within a reasonable time unless it is impossible for us to do this because of circumstances outside of our reasonable control. In particular we will not be responsible for delays caused by our suppliers



Data protection

Your personal data in relation to your order will be kept in accordance with the provisions of the Data Protection Act (1998). We reserve the right to monitor and record telephone calls to and from our Helpdesk for legal and training purposes.



Title of goods

The goods are at your risk from the time of delivery. Ownership of the goods shall not pass to you until we have received in full (in cash or cleared funds) for the debt due to it in respect of the goods, which are or which become due to us from you on any account. We shall be entitled to recover payment for the goods notwithstanding that ownership of any of the goods has not passed from us.



Delivery.

Unless you have otherwise agreed in writing, goods shall be delivered to the address you advise when ordering from us, however we cannot deliver to PO Box addresses. Delivery prices and estimated times for delivery are quoted on this basis for UK mainland only. If we are unable to deliver to the address stated in your order to us we will post a card to that address asking you to collect from a local depot.



Your Prescription
Your prescription must not be more than 12 months old . We will rely on the prescription given by you to manufacture and supply lenses in accordance with that prescription. If you do not supply us with a pupillary distance measurement (PD) we reserve the right to glaze your lenses at an average Pupillary Distance (PD) of 63mm, at our discretion. Additionally you must be aged 18 years or over and resident in the UK.



Product descriptions.

Whilst every effort is made to ensure an accurate image of the products sold descriptions and photographs of products are for illustration purposes only. Model numbers may change without notice.



Returns and Cancelled Orders
You have the right to cancel your order at any time. However, should work have been commenced prior to cancellation, you are liable for the cost of the work done, together with any expenses incurred on your behalf.  The cost of carriage and insurance is non-refundable.

When you receive your order, you are advised to inspect it carefully, and make certain that it is of merchantable quality and fit for its intended purpose. In cases where goods dispatched were faulty, or incorrect because of a failing on our part, we will refund the total amount of the order for the goods returned. The cost of carriage and insurance is non-refundable.

All goods must be returned in the same condition as they were dispatched and must be unused. They must be returned with all of the appropriate documentation and packaging. Any damage or loss to either the product, packaging or the documentation may affect the amount of refund made.

We will not be liable for any errors made by you, on our order form, or any damages arising out of an incorrect prescription being supplied to us by you.
